Terms of Use (EULA)

These Terms of Use (referred to as the “Terms” or “Agreement”) constitute a binding legal agreement between you (referred to as “User”, “you”, or “your”) and Mert App (referred to as “we”, “us”, “our”, or the “Developer”) regarding your use of the mobile application AI Speak French: Practice Me (referred to as the “App” or “Application”).

By downloading, installing, or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, or use the Application.

1. Scope of License

The Developer grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Application on any Apple-branded products running iOS that you own or control, in accordance with these Terms and the App Store Terms of Service.

2. In-App Purchases and Subscriptions

The Application offers premium features accessible via in-app purchases or auto-renewing subscriptions (e.g., Monthly or Annual plans).

Billing: All billing transactions are processed securely through the Apple App Store. Your payment method associated with your App Store account will be charged at the confirmation of purchase.
Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless auto-renew is turned off at least 24 hours before the end of the current period.
Management & Cancellation: You can manage your subscriptions, view billing history, or cancel your active subscription at any time through your Apple ID Account Settings.
Refunds: All refunds are handled exclusively by Apple. We cannot issue refunds directly to users.

3. User Code of Conduct

By using the Application, you agree to use it only for lawful purposes. You agree not to:

Use the App to generate, transmit, or share any content that is offensive, unlawful, defamatory, abusive, harassing, or violating third-party rights.
Attempt to reverse engineer, decompile, or extract the source code of the Application.
Disrupt or interfere with the secure operations of our servers, APIs, or connected third-party networks.

4. Artificial Intelligence Disclaimer (AI Content)

Processing: The interactive conversational features of the App are powered by the Google Gemini API.
Accuracy: While our AI coach is designed to offer high-quality grammatical corrections, translations, and conversational replies, AI-generated content may occasionally contain inaccuracies, stylistic anomalies, or errors.
Liability: We do not guarantee the absolute accuracy or completeness of the AI responses. The App is provided for educational and language practice purposes only and should not be relied upon as a professional translation service.

5. Intellectual Property Rights

All ownership rights, copyrights, trademarks, source code, designs, and database rights related to the Application (excluding third-party libraries and APIs) remain the exclusive property of the Developer.

6. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of or inability to use the Application, even if we have been advised of the possibility of such damages.

7. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Application (e.g., Apple’s App Store Terms of Service, Google Firebase terms, and RevenueCat terms).

8. Apple Inc. as Third-Party Beneficiary

You and the Developer acknowledge that this Agreement is between you and the Developer only, and not with Apple Inc. Apple Inc. has no obligation to provide any maintenance or support services for the Application. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if applicable) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the Application.
